I. BACKGROUND
Participants in an ordinary long distance run are easily injured. In connection with the 2009 TNF100 Beijing Changping Outdoor Endurance Challenge Run, the risk remains given the high number of participants. Therefore, organizers of the event recommend that all participants receive a thorough medical check-up prior to running in the marathon. The following terms and conditions are outlined in order to raise awareness of participant safety and health prior to participating in a marathon.

II. RISK OF PARTICIPATION
By signing this document the participant accepts that his participation in the marathon is his own responsibility and he has entered at his own risk in every regard. The participant accepts that he/she cannot claim any kind of damages, indemnification or any other compensation for personal injury, damage to property or any other loss, including any kind of indirect loss in connection with his participation in the event, from the organizers of the 2009 TNF100 Beijing Changping Outdoor Endurance Challenge Run, unless he is subjected to any kind of injury or loss due to gross negligence on the part of the 2009 TNF100 Beijing Changping Outdoor Endurance Challenge Run or its staff. At the same time, organizers of the event cannot be made liable for negligence displayed by independently participating third parties or the local authorities prior to, during, or after the running.

III. MEDICAL ASSISTANCE
Medical assistance will be available to all participants of the 2009 TNF100 Beijing Changping Outdoor Endurance Challenge Run along the race route. If on-site medical staffs determine that a participant is not fit to continue the race, the participant in question will be removed from participation in the running. Organizers of the 2009 TNF100 Beijing Changping Outdoor Endurance Challenge Run will defer to the expert opinion of the medical staff and do not undertake responsibility for such a decision as it was made taking the participant’s greater health into consideration.

IV. SPONSORS
The 2009 TNF100 Beijing Changping Outdoor Endurance Challenge Run depends a great deal on the contributions and efforts of our event sponsors. Keeping this in mind, the organizers of the marathon aim to uphold and protect the rights and interests of our event sponsors. Therefore, on October 19, no participant may wear or promote any brand or company that is seen as conflicting with the interests of a 2009 TNF100 Beijing Changping Outdoor Endurance Challenge Run sponsor. If a participant is considering wearing apparel with logos or writing exceeding 3x5 cm, please contact the marathon organizers for written permission.

V. IMAGE RELEASE
Participation in the 2009 TNF100 Beijing Changping Outdoor Endurance Challenge Run signifies a possibility that a participant may be photographed or filmed during the event. All participants must be aware that their image may be used in future promotional material for the TNF100 Endurance Run. All rights in relation to images taken and used from the event belong to the organizers of the TNF100 Endurance Run. Permission to use the name TNF100 Endurance Run or images from the event used for commercial purposes must be obtained in writing from the event organizers prior to use.

VI. CHINESE AUTHORITIES
The 2009 TNF100 Beijing Changping Outdoor Endurance Challenge Run would not be possible without the support and assistance of the Chinese authorities. Traffic control and medical aid are some of the services that the Chinese authorities help to coordinate for the event. Therefore, all participants must respect and adhere to any order given by the local authorities. Any hostile confrontation between runners and local authorities would reflect negatively on the event and could result in the future cancellation of the marathon.

VII. CHOICE OF LAW AND VENUE
By registering and participating in the 2009 TNF100 Beijing Changping Outdoor Endurance Challenge Run, participants accept that any dispute in relation to their participation in the event will be subject to Chinese law.
